Met dat direct-democratisch instrument kan de bevolking rechtstreeks beslissen, ook tégen de wil van de politici in.

For the implementation of direct democracy there seem to be, three proposals:

1) Direct democracy is subjected to “...zwingende Völkerrecht”
--> advocated by Prof. Dr. Hansjörg Seiler
"Volk und Verfassung
Die Rolle des Staatsorgans Volk im schweizerischen Verfassungsrecht"

Critique (Jos Verhulst):
Blijkbaar bestaat er tòch een autoriteit boven het volk, die het zogenaamd ‘ius cogens’ ofte ‘dwingend volkerenrecht’ kan opleggen. Dit vermeende “...zwingende Völkerrecht” geldt volgens Seiler sowieso, en het volk heeft terzake niets in de pap te brokkelen: “...zulässig sind nach dem klaren Wortlaut der Verfassung alle Verfassungsänderungen mit dem einzigen Vorbehalt des zwingenden Völkerrechts”, en: “Ausgeschlossen ist eine Kündigung in Bezug auf zwingendes Völkerrecht, weil dieses absolut und überall gilt. Logischerweise statuiert denn auch die Verfassung, dass Volksinitiativen als ungültig zu erklären sind, wenn sie gegen zwingendes Völkerrecht verstossen, weil man eben zwingendes Völkerrecht nicht durch Volksentscheid aufheben kann. Abgesehen von diesem seltenen Fall ist aber Völkerrecht keine Schranke für die demokratische Rechtsetzung”.

Volgens Seiler is de hoogste autoriteit in Zwitserland dus de geheimzinnige instantie, die het “...zwingende Völkerrecht” uitvaardigt. Daaronder volgt dan, als ondergeschikte autoriteit, het volk. Zwitserland is dus in letterlijke zin geen democratie, vermits het volk in Zwitserland niet de hoogste wetgevende instantie blijkt te zijn. Deze conclusie wordt door Seiler min of meer verdrongen

"Meer algemeen zal democratische besluitvorming zichzelf vernietigen wanneer besluiten worden genomen die impliceren dat mensen niet meer als vrije en soeverein denkende individuen tegenover elkaar kunnen staan. Daarom zullen alle besluiten, die ertoe strekken om het individuele denken onder staatscontrole te plaatsen, vernietigend inwerken op de democratie. "

Conclusion: This type of direct democracy has the danger to be dominated and even ruled by the people who have the monopoly of interpretation of “...zwingende Völkerrecht”
This is still a situation of slavery.


2) Directe Democracy has to limit itself, and these limits have to be discovered.

"Het natuurrecht vloeit niet voort uit één of andere externe openbaring op één of ander van bovenaf opgelegd decreet. Evenmin is het natuurrecht een soort rationele afweging of hypothese, die een grotere of kleinere kans heeft om min of meer waar te zijn. Het natuurrecht vloeit strikt logisch voort uit de natuur van de mens als denkend en waarheidszoekend wezen. Argumenteren over gelijk welk onderwerp (bijvoorbeeld over de herkomst van het recht) gebeurt in logisch opzicht niet kosteloos. Ieder concreet betoog geschiedt immers binnen het kader van een aantal impliciete vooronderstellingen, die men moét aannemen om de act van het argumenteren op zich, los van iedere expliciete inhoud, logisch contradictievrij te houden. Dientengevolge kan in de expliciete inhoud van het argument niets worden opgenomen dat logisch onverenigbaar is met het algemene feit dat men überhaupt argumenteert."

"Het fundamenteel rechtsbeginsel, zoals hierboven geformuleerd, biedt het rationeel uitgangspunt voor het natuurrecht. Rechtsschepping vooronderstelt in tweevoudig opzicht redelijk overleg tussen mensen: enerzijds kan men niet aan rechtschepping doen zonder de mogelijkheid tot redelijk overleg te erkennen, en vervolgens kan men ook niet aan rechtschepping doen zonder uit te gaan van het beginsel dat men rationeel behoort te handelen. Met ande-re woorden: de reflexieve toepassing van de rede op de rede zelf levert ons de ezelsbrug, die vanuit het rationele domein voert naar het morele domein. "

"Op dit punt gekomen herkennen we de ware aard van het democratisch dilemma. Ofwel kiezen we de menselijke weg, dat wil zeggen de weg die uitgaat van de mens als sprekend en rationeel wezen, ofwel kiezen we die weg niet. Strikt genomen verkeren we zelfs in de onmogelijkheid, om in de volle zin des woords tégen genoemde weg te kiezen, want ‘kiezen’ vooronderstelt immers redelijkheid, en die zou door zo’n tegenkeuze juist worden ontkend."
and
"Democratie vooronderstelt, dat de deelnemers aan het democratisch proces als autonome denkers kunnen functioneren: ze moeten vrij van alle mogelijke informatiebronnen kennis kunnen nemen en vrij hun oordelen kunnen vormen en uitspreken. Zij dragen hun gedachten, die in vrijheid zijn ontwikkeld buiten iedere controle door de rechtstaat, binnen in het democratisch verwerkingsproces."

Critique:
The limitations are still very vague.
In reality, in a community with unlimited voting rights about everything, someone joining this community, can still find him/her from one day to another loosing his life, freedom or property, and there is nothing that could stop this.
This seems to be like a situation of arbitrary law (also disguised by the term “positive law”)
In a direct democracy with unlimited voting rights about everything, this means that dictatorship is transferred from the ruling politicians to "the majority", and the ruling majority decides on your life, freedom and property in an ad hoc direct voting. This means it is only a shift in dictatorship. For many people, the situation under “direct democracy with unlimited voting rights on everything” might be even worse at a certain moment than under dictatorship or particracy situation..
The only additional right in such a system, is that you have the right to vote. According to my understanding this is not sufficient to talk about "Civil Rights" if only limited to vote.
According to my understanding, some people aiming for direct democracy, are not talking about "Civil Rights" but the replacement of one dictator (the ruling political party) by another dictatorship.
i.e. in a representative democracy (or particracy) politicians decide about your life, freedom and property.

Conclusion:
This type of direct democracy has the danger to the replacement of one dictator (the politicians of the ruling political party which take away your life, freedom and property. by another dictatorship: the majority.
In a direct democracy with unlimited voting rights about everything, but “voluntary limited”, this means that dictatorship is transferred from the ruling politicians to "the majority", and the ruling majority decides on your life, freedom and property in an ad hoc direct voting. This means it is only a shift in dictatorship. For minorities, the situation under “direct democracy with unlimited voting rights on everything”, might be even worse at a certain moment than under dictatorship or particracy situation..


3) Directe Democracy has to remain fully within what has been agreed at front: explicit social contract with a small community, and different choices of social contracts must exist (because there are different communities not too far away).
- This model is to a important extend presented in the ideas of Hans-Hermann Hoppe in the book “Democracy, The God that failed”.

Model is: condominium
has many similarities with companies
Basic building block of the community: the free and independent city (community)
Cities can agree to cooperate on certain areas into “kantons” or “regions”

In principle the right of self ownership of life freedom and property is valid (= fundamental rights).
However by joining a community, new rights are received, however this is accompanied by new duties (which violate in principle the fundamental rights).
It is understood that such an agreement is made voluntary by the newcomer, and that the benefits of joining are higher than the alternative solutions available (not joining a community, or joining a different community).
Direct Democracy must be limited to the areas which have been agreed up at front,
e.g.
the moment someone is taken up as "adult" in a community, preferably in an explicit social contract.
or
the moment a new immigrant (from another community) is accepted as new inhabitant for the community.

I understand that there might be new issues and areas which appear after some time, not foreseen in the social contract.. In this case, it can be agreed that majority rule applies, and that the people who are victim of the decision, need to be compensated.
Important before signing a social contract is that people have the choice between different social contracts.
If there is no choice, the unbalance of power is excessive, and one can no longer say this is a contract agreed in freedom.
Note: It is possible that some communities the social contract allow unlimited voting rights about everything, or that the boundaries have to be discovered, or that the boundaries are determined by “...zwingende Völkerrecht”
At least people who join this type of community, know what they join at front.

Conclusion: Only a democracy, which is limited by contractual agreements, offers the guarantee not to violate the fundamental rights of its inhabitants, and according to my understanding has the highest chance to remain stable.
