A quick overview of the ruling: A divided Supreme Court upheld the constitutionality of the Obama administration’s health-care law, in one of the most anticipated high-court rulings in a generation. The court said Congress was acting within its powers under the Constitution when it required most Americans to carry health insurance or pay a penalty—the provision at the center of the two-year legal battle. It upheld the mandate as a tax, in an opinion by Chief Justice John Roberts.



The ruling is a victory for Democrats and President Barack Obama, who had passed the biggest reworking to the health system since the creation of Medicare in the 1960s and faced the prospect of the court nullifying their effort. It also averts disruption for hospitals, doctors and employers who have spent more than two years preparing for changes in the law.



Even as the law’s fate was in doubt, the administration moved ahead with implementing its provisions.

Besluit: Men mag dus de burgers van de VS verplichten tot het afsluiten van een verzekering en zij die dat niet doen kunnen een boete opgelegd worden.

Een overwinning voor Obama, de banken en verzekeringsmaatschappijen.

Een groot verlies voor de vrijheid.

Hopelijk hebben sommige gewone burgers er uiteindelijk toch baat bij.

Ginsburg favored going further, and allowing the mandate under the commerce clause.

The court also upheld the federal government’s ability to expand Medicaid coverage, but said the government could not withdraw existing Medicaid funding from states that opt out of the expansion.

The complex decision— a major victory for the White House less than five months before the November elections--will help redefine the power of the national government and affect the health-care choices of millions of Americans.

Passage of the Patient Protection and Affordable Care Act by the Democratic-controlled Congress in 2010 capped decades of efforts to implement a national program of health care. The legislation is supposed to eventually extend health-care coverage to more than 30 million Americans who currently lack it.

Supreme Court Rules in Favor of Obamacare
June 28, 2012 - In a victory for the New Deal bastardization of the Constitution, the Supreme Court has ruled that the government can mandate at gunpoint that Americans buy monopolized health care insurance.

Een grote verrassing aangezien iedereen er de laatste maanden - gelet op de kritische hoorzitting van het Hof - er van uit ging dat de conservatieve meerderheid (Roberts, Scalia, Kennedy, Thomas en Alito) de wet ging vernietigen... maar klaarblijkelijk heeft de Chief Justice John Roberts verrassend genoeg de kant gekozen van de liberale minderheid (Ginsberg, Breyer, Sotomayor en Kagan).

Inderdaad, onverwachts en een grootse overwinning voor de Democraten... Democrats beter.

Ik geloof dat alle weldenkenden die beslissing alleen maar kunnen toejuichen. Mijn enthousiasme hangt evenwel van de opgelegde prijs af.
Wat gaan ouderen en mensen met pre-existing condities betalen?

Juridisch gezien is het dus niet op grond van de "commerce clause" dat de wet overleeft, maar omwille van het feit dat de "penalty" wordt beschouwd een belasting te zijn, wat binnen de bevoegdheden van het Congress ligt. Blijkbaar was de "commerce clause" - wat de vier liberale rechters voorstonden - voor Roberts een brug te ver.

neen, Elena Kagan, in 2010 door Obama benoemd. Zij is voormalig decaan van de rechtenfaculteit van Harvard en de vorige US sollicitor-general (oftwel de officiele landsadvocaat) van Obama.

Is de verplichting om religieuze instellingen verplicht te laten betalen voor contraceptie, sterilisering en abortussen ook goedgekeurd? Het is een ernstige schending van de vrijheid van religie, en ook één van de voornaamste discussiepunten. Een hele hoop religieuze ziekenhuizen en ziekenfondsen zullen mogelijk sluiten.

Logisch toch? Als doctor dien je gewoon een abortus uit te voeren als de moeder dat wilt.

Het gaat om ziekenhuizen van religieuze instituten, op hun kosten. Het zijn ziekenhuizen die er anders niet zouden zijn.

Abortus is in de meeste gevallen een luxe-ingreep. Zo'n luxe-ingreep moet dan plots verzekerd worden als ware het een ziekte (voor noodzakelijke abortus kan ik er in komen, maar daar gaat het dus ook niet om).

Helemaal mee eens hoor, ik was mijn smiley,s vergeten.;-)

Al ben ik het er niet helemaal mee eens, om abortus als een luxe probleem af te doen.

Het probleem is dat vele Democrats zo denken. Ze schieten vooral in eigen been.

Ik weet het.

Met luxe-ingreep duidt ik vooral op dat het in de meeste gevallen geen noodzaak is. Men gaat dat verheffen boven levensbelangrijke ingrepen die christelijke ziekenhuizen wél leveren (de Katholieke ziekenhuizen behoren trouwens tot de beste van Amerika).

Ik snap je redenatie, alleen wie gaat bepalen of iets noodzakelijk is of niet? Soms kan abortus voor een moeder erg noodzakelijk zijn.

En dan bedoel ik niet, wanneer de moeder zelf in levensgevaar is.

Is het dan zo'n moeite om naar een ander ziekenhuis te gaan? Het gaat er vooral om dat christelijke ziekenhuizen zo'n ingreep niet willen uitvoeren en ook niet willen verzekeren. Iemand die geen christen moet dan ook niet bij een christelijk ziekenfonds gaan, en niet verwachten dat een christelijk ziekenhuis een abortus uitvoert.
