Blast for Racists Henricsson from attorneys
 
Retired Major General of the Swedish army, Ulf Henricsson , Chief of the Sri
Lanka Monitoring Mission who jumped the gun and concluded without proper
scientific and forensic evidence that the 17 aid workers of the French NGO
Action against Hunger were killed in Muttur by the armed forces is being
blasted from several sides.

He is being slammed by the government of Sri Lanka for issuing a statement
based on speculation, innuendo, so-called evidence from anonymous sources,
and partial towards the LTTE. It has been called unprofessional and
outrageous.

The government has invited Australian forensic experts to investigate the
killing. Henricsson is no forensic expert and this is a judicial matter.

A statement has been issued against him by the Peace Secretariat, and
newspaper editorials have been written. But the most telling indictment
comes from the legal fraternity, by two wellknown attorneys.

S L Gunasekera, who participated in the Thimpu talks, was President of the
Sihala Urumaya and a prominent political activist and Gomin Dayasiri who was
a delegate at the Geneva talks have issued a statement which is analytical,
factually documented where events are recorded as they happened. Strangely
enough they point to instances where the security forces and the LTTE's
mouthpiece Tamilnet agree in their statements.

The emotional Henricsson is on his way out and this is his parting shot at
the security forces and his gift to the LTTE which is at the moment reeling
under several defeats. The SLMM has been repeatedly making the point that
without proper evidence it cannot give rulings against the innumerable
killings by the LTTE.

Gunasekera and Dayasiri assert that the report is false and that the pivotal
questions at issue here are;-

1. What was the time of death?

2. Who was in control of Muttur at the time of death?

According to the Judicial Medical officer who performed the post mortem the
probable time of death was between the night of August 3rd and August 4
2006.

According to Henricsson the Action against Hunger office in Trincomalee kept
telephoning the Muttur office every half hour between August 1st and 06. 10
hours on August 4th. After that there was no reply to radio, phone calls and
FAX messages.

The attorneys maintain that therefore the overwhelming probabilities are
that the deaths took place in the early hours of Friday August 4.This
accords with the JMO's opinion and the evidence of the Trincomalee office of
Action against Hunger.

Henricsson has dishonestly tried to make out that the LTTE quit Muttur town
on Thursday Aug.3, bringing the security forces back on that day to Muttur.
This is false and is borne out by both the security forces and the LTTE and
they are unanimous.

Tamilnet said that the LTTE was in control of Muttur town from around 02.35
GMT [ie 9 pm]on August 1st until midnight on Friday August 4th [See Tamilnet
news items of 2.35 hours GMT on 2.8.06;19.18 hours GMT on 2.8 .06 and 11.04
GMT on 5.8.06]

On 5.8.06 Tamilnet said at 11.04 GMT: The military spokesman of the LTTE
Irasaiah Ilanthiayan said that the LTTE troops left Muttur by midnight
Friday August 4th and returned to their original positions as per February
22 2002 Ceasefire agreement.

The security forces say the same thing. They regained control of Muttur in
the course of August 5th 2006. So the LTTE was in Muttur between August 1st
and 4th.

Tamilnet gives us more evidence to support the view that the LTTE is guilty
of the crime.Tamilnet in its bulletin datelined 14.28 GMT on 5.8.06 says
that the Sri Lanka army had killed 15 Tamil workers.

Their bulletin datelined 7.26 GMT on August 8 2006 however says that the
bodies were found on August 6. So how did the LTTE make an announcement
about the killing on August 5th, when they themselves say that the bodies
were found on August 6th?

Henricsson purports to found his findings to place guilt on the security
forces from reports he is said to have received from unnamed, unidentified
persons. No credibility can be placed on such material, say the two
attorneys.

Henricsson has faulted the EU in an interview with AFP for banning the LTTE
and said that it would harden the terrorists and aggravate violence by them.

Apparently of you do not pamper and coo to the Tigers they get out of hand.

Henricsson has also said that the EU decision had been made in the cafes of
Brussels. Clearly, Henricsson has no objection to the jungles of the Wanni
to which he makes frequent jaunts.

Henricsson says corny things. "if one is suddenly on a terrorist list it is
not difficult to see that we are going to run into difficulties."

Suddenly? For several years now the LTTE has been clapped with the terrorist
label and where was Henricsson when India, the US, Britain, Canada and the
EU were declaring the LTTE as terrorists.

Henricsson and many others are not aware that LTTE was banned even in Sri
Lanka on Jan 2, 1998, a day after they devastated Sri Lanka's holiest
Buddhist shrine, the Temple of the Tooth located in Kandy , in a suicide
bombing undertaken by the LTTE.

Even the Ceasefire agreement between the Sri Lanka Government and the LTTE
was signed in February 22, 2002 while the ban was on. Subsequently, the ban
was lifted on 09 September 2002, only a week before the commencement of the
first round of talks between the Sri Lanka Government and the LTTE.

The 'Island' wrote in an editorial recently: The SLMM is convinced that it
does not have a cat in hell's chance to whitewash the Tigers who have cooked
their goose. But the Vikings are smart enough to know that there is more
than one way of skinning a cat. If the LTTE cannot be painted white, then
the alternative is to paint its enemies -the security forces raven black.
