Dissemination of propaganda material of unconstitutional and terrorist organisations

(1) Whoever disseminates or makes available to the public in Germany or produces, stocks, imports or exports for dissemination in Germany or abroad the propaganda material

1. of a political party which has been declared unconstitutional by the Federal Constitutional Court or a political party or organisation which has been held by final decision to be a surrogate organisation of such a party,

2. of an organisation which has been banned by final decision because it is directed against the constitutional order or against the concept of international understanding or which has been held by final decision to be a surrogate organisation of such a banned organisation,

3. of a government, organisation or institution outside the territorial scope of this statute which is actively pursuing the objectives of one of the political parties or organisations referred to in nos. 1 and 2 or

4. the content of which is intended to further the activities of a former National Socialist organisation

incurs a penalty of imprisonment for a term not exceeding three years or a fine.

(2) Whoever disseminates or makes available to the public in Germany or produces, stocks, imports or exports for dissemination in Germany or abroad the propaganda material of an organisation which is listed as a person, group or entity in the Annex to Council Implementing Regulation (EU) 2021/138 of 5 February 2021 implementing Article 2 (3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism, and repealing Implementing Regulation (EU) 2020/1128 (OJ L 43, 8.2.2021, p. 1) incurs the same penalty.

(3) Propaganda material within the meaning of subsection (1) is only such content (section 11 (3)) which is directed against the free democratic basic order or the concept of international understanding. Propaganda material within the meaning of subsection (2) is only such content (section 11 (3)) which is directed against the existence or the security of a state or of an international organisation or against the constitutional principles of the Federal Republic of Germany.

(4) Subsections (1) and (2) do not apply if the act serves civic information, to prevent unconstitutional activities, to promote the arts or science, research or teaching, reporting about current or historical events, or similar purposes.

(5) If the degree of guilt is minor, the court may dispense with imposing a penalty under this provision.
Hier staat zeer duidelijk te lezen dat je geen propaganda mag maken voor verboden partijen (de NSDAP valt daar zeker onder) door middel van propagandamateriaal. Er staat nergens dat je je niet positief mag uitlaten over de NSDAP of gelijkaardige organisaties. En dat lijkt me maar normaal ook, het zou van Duitsland een echte dictatuur maken.

Met andere woorden: als jij op de Grote Markt van Keulen gaat staan en tegen voorbijgangers zegt dat de NSDAP ook goede dingen gedaan heeft, zal je wellicht verstoring veroorzaken (de politie zal je oppakken, dat is zeker) maar je hebt niks strafbaars gedaan en je kan niet gestraft worden.
