The case of Elvira Arellano illustrates two things beyond the issue of immigration: The first is that human rights, which persons with "criminal records" are also supposed to have, are never placed before "national sovereignty." The second is that persons with so-called "criminal records" lose their humanity and are placed in a category that makes them subhuman. Now, are the jackboots in the Department of Homeland [In]Security actually going to go jackbooted, with machine guns, into the Aldalberto United Methodist Church. Yep - given the state of American government toward fascism and legalized criminality, there could be Homeland [In]Security thugs crashing into a Christian Church. Would the jackbooted thugs of Homeland [In]Security also do the same to a mosque, where real terrorists might very-well be hiding? I doubt it.and remember, these are the same rational, sane people in the same civil rights-conscious agency that placed elderly, peace promoting nuns on "no fly lists" and deemed them "threats to aviation." Second is an issue that I have visited before, that is, when is comes to so-called "criminal record" (especially from country of origin) and migration. There are several problems and an argument against disqualifying a migrate based on "criminal record" can be developed first from the over-generalization of "criminal record." First, as I always have to do, the presence of a "criminal record" does not mean that the person is a murder, child molester, or the worst possible violent offender. What come up are generalizations about an immigrant's "criminal record" as being the worst possible criminal acts, and this generalization, it can be argued, violates basic human rights. The effect is that a migrant is then placed in a category of "criminal" and he or she does not, ever in their lives, have the same status as other human beings. This goes along with the permanent stripping of the basic humanity and dignity of a person found to have a "criminal record." Also, it should be a violation of human rights to deport a migrant with a "criminal record" just to be mean and punitive. Also, most people that want to migrant to the United States and other nations with "criminal record" exclusion rules, what I have called Scarlet Letters laws, have minor and dated "criminal records." For example, if a young college student at the University of Toronto gets into minor trouble in 1987 college prank and acquires a "criminal record" as a result. The fellow goes on to get a Ph.D. in a high tech field and is a bright star in his field. He is then invited to come to the United States or a European country to teach at a technical university. Well, because of his arrest wayyyyyyy back in 1989, he will be refused a residence permit for most European countries and would have extreme trouble getting into the United States. Now, let's say that the prestigious MIT, the Massachusetts Institute of Technology wanted this guy, but are out a high valued prospect just because of a minor "criminal record" from the man's young and dumb days. This situation is a crime in and of itself - and as a result of foolish Scarlet Letter policies that many nations with regard to migration and "criminal record," the nation is out a valued scientist for absolute stupid reasons. The only humane solution is to examine, one a case by case basis, the migrants' "criminal record" and whether the migrant with a "criminal record" really poses a threat to public safety and security. In the example above, the nation was robbed of a high valued and productive potential citizen because of stupid Scarlet Letter laws. It is doubtful that Elvira Arellano is a threat to safety and she is NOT Ted Bundy or Jeffery Dahlmer. Now - doesn't the jackboots at the Department of Homeland [In]Security have something else better to do - like catch real terrorists?! Let's help the Department of Homeland [In]Security discover its real mission by first telling them in loud voices to LEAVE Elvira Arellano ALONE!!! |
