https://www.theguardian.com/uk-news/...eu-brexit-deal
EU citizens * EU citizens in the UK and UK citizens in the rest of the EU have the right to stay. Rights of their children and those of partners in existing “durable relationships” are also guaranteed. * UK courts will preside over enforcing rights over EU citizens in Britain but can refer unclear cases to the European court of justice for eight years after withdrawal. Irish border * The agreement promises to ensure there will be no hard border and to uphold the Belfast agreement. * It makes clear the whole of the UK, including Northern Ireland, will be leaving the customs union. * It leaves unclear how an open border will be achieved but says in the absence of a later agreement, the UK will ensure “full alignment” with the rules of the customs union and single market that uphold the Good Friday agreement. However, the concession secured by the DUP is that no new regulatory barriers will be allowed between Northern Ireland and the rest of the UK without the permission of Stormont in the interest of upholding the Good Friday agreement. Money * There is no figure on how much the UK is expected to pay but the document sets out how the bill will be calculated – expected to be about £50bn. * The UK agrees to continue to pay into the EU budget as normal in 2019 and 2020. * It also agrees to pay its liabilities such as pension contributions. The two sides agreed there would be need for cooperation on nuclear regulation and police and security issues. There was an agreement to ensure continued availability of products on the market before withdrawal and to minimise disruption for businesses and consumers. |

Nobody even has the faintest idea how the no hard border will look like or function.
Nevertheless. A stunning success for everybody... This is an understatement...Especially for the leavers. All they have effectively done is to say there is no solution but they will find one. This is, as the Germans say, to get the cow off the ice and finish the first round of negotiations in order to be able to start the second round. Um die Kuh vom Eis zu holen |

New
A bit more wordy conclusion of Owen Jones: Eighteen months of bluster, of “Brexit means Brexit”, of “red, white and blue Brexit”, of “no deal is better than a bad deal”. And for what? Brexit, it turns out, means whatever the EU27 want it to mean. The EU has conceded nothing meaningful; Theresa May’s stringent red lines turned out to be easily wiped away. “So much time has been devoted to the easier part of the task,” as the EU’s Donald Tusk puts it: now a year remains for the hard part. Let’s just consider what has happened after the Tories’ pointless theatrics. The Irish border question has been neatly folded and placed into the “hopefully this will sort itself out somehow at some point” box. The DUP is sceptically frowning at the box and has publicly reserved its right to kick off again as soon as another attempt to resolve the impossible is made. Britain has agreed to pay the EU vast amounts of money, probably between £35bn and £39bn: note that David Davis previously tried to calm Tory backbench anger over a reported £40bn bill on the basis it was “made up”. The European court of justice will continue to play a key role for many years: Brexiteer journalist Isabel Oakeshott publicly worries that “Many Brexiteers will be dead before the ECJ releases its chilling grip on this country,” adding the hashtag “sellout” for good measure. But then there’s the absolute mother of all concessions. If no way of preventing a hard border in Ireland is discovered, then the UK “will maintain full alignment with those rules of the internal market and the customs union”. Have hardcore Brexiteers begun to process these words? As things stand, Britain is heading for long-term de facto membership of the single market and the customs union, even if we are technically in neither, in order to preserve the Northern Irish peace process. We will simply have to observe regulations that we have no power over and no say in making. Taking back control, indeed. |
