De grootste Amerikaanse bank JPMorgan Chase gaat een recordbedrag van vier miljard dollar betalen om te ontsnappen aan vervolging door de Amerikaanse toezichthouder op de hypotheekmarkt FHFA. Dat heeft de krant The Wall Street Journal gisteren uit goede bron vernomen.

De FHFA voert al een tijd onderzoek naar het gesjoemel op de Amerikaanse hypotheekmarkt dat aan de basis lag van de wereldwijde financiële crisis die een vijftal jaar geleden losbarstte. De toezichthouder verdenkt JPMorgan ervan dat de grootbank de hypotheekverstrekkers Fannie Mae en Freddie Mac bedot had met de verkoop van derivaten van riskante hypothecaire leningen.


Volgens The Wall Street Journal zouden de FHFA en JPMorgan op het punt staan te schikken voor vier miljard dollar. Volgens de krant had de toezichthouder eerder zes miljard dollar geëist.

JPMorgan Chase bank ontkent het verhaal...
The reports are referring to a new $50,000 limit on monthly cash activity being imposed on small business checking accounts and a ban on outgoing international wire transfers on those accounts.

Small business customers received letters from the bank stating that the changes are effective November 17. “These changes will help us more effectively manage the risks involved with these types of transactions,” the letter states.

One report dubs Chase’s new rules “a war on cash and a war on small business and individuals” and says the new rules will lead to “a total cashless society that destroys all privacy and allows them to fine and fee the general population into serfdom.” Scary stuff.


The fear is that banks, and indirectly, the federal government have too much control over individuals’ money which sits in the form of deposits. Limiting withdrawals and keeping people from sending money overseas feels like capital control–a government attempt to prevent money from flowing out of the country. Think Iceland and Cyprus.

JPM says that’s not what’s happening here.


First, a quick visit to the bank’s business banking website shows that international transfers are still available–you just have to pay up for them.

The bank’s basic business account, Chase Total Business Checking, does not allow outgoing international wire transfers (it does allow them to come in) and cash activity is indeed limited to $50,000 per month. Cash activity means withdrawals and deposits. The account has a $10 monthly fee which is waived with a $1,500 minimum daily balance.

Need to withdraw or deposit more than $50k? You can but you’ll have to pay more in monthly fees to do so.

Upgrade to Chase’s Performance Business Checking and there’s no cash activity limit. Plus, you get two domestic wires transfers per month at no charge and international wires are available for an additional fee. Of course, there’s a $20 monthly fee that’s waived if you can maintain $50,000 balance.

Upgrade even higher to the Chase Platinum Business Checking and get four outgoing wires per month at no charge and reduced pricing on additional wires. Again, no cash activity limit here but the Premium account has a whopping $95 monthly fee that is waived if deposit balances are $100,000 or more.

But let’s get back to that basic business account. Chase says you can still exceed the $50,000 cash activity limit but do it four times in a rolling calendar year and you’ll get automatically upgraded to the next level account.


So, no, there is no cash activity limit in the Performance Business and Platinum level accounts but you’ll have to maintain higher balances to avoid the larger monthly fees.

It looks like theses changes are more about Chase looking to generate more revenue from fees than an attempt to control capital.

In an apparent effort to front-run official government capital controls, JP Morgan Chase has issued letters to all its business account holders notifying them that as of November, 17 the bank will limit all cash transactions (including deposits, withdrawals, and ATM usage) to $50,000 per month, and will prohibit all outgoing international bank wires. JP Morgan Chase later disclaimed, however, that the news that the bank is exerting new capital controls on certain bank accounts are an overreaction to a "streamlining" and "derisking" process.

Chase Bank has moved to limit cash withdrawals while banning business customers from sending international wire transfers causing speculation that the bank is preparing for a looming financial crisis in the United States by imposing capital controls.Bank officials confirmed Wednesday that the new capital limits apply to all business account holders, the bank will stop processing any outgoing international bank wire, and that any monthly cash transactions in excess of the new $50,000 limit will be subject to penalties and fees.

JP Morgan has been broken down by an enormous fine as it works to clear up the mess created by the London Whale trading scandal.

BLOOMBERG - PBOC Says No Longer in China’s Interest to Increase Reserves
20 november 2013 - The People’s Bank of China said the country does not benefit any more from increases in its foreign-currency holdings, adding to signs policy makers will rein in dollar purchases that limit the yuan’s appreciation.

“It’s no longer in China’s favor to accumulate foreign-exchange reserves,” Yi Gang, a deputy governor at the central bank, said in a speech organized by China Economists 50 Forum at Tsinghua University yesterday. The monetary authority will “basically” end normal intervention in the currency market and broaden the yuan’s daily trading range, Governor Zhou Xiaochuan wrote in an article in a guidebook explaining reforms outlined last week following a Communist Party meeting. Neither Yi nor Zhou gave a timeframe for any changes.

China’s foreign-exchange reserves surged $166 billion in the third quarter to a record $3.66 trillion, more than triple those of any other country and bigger than the gross domestic product of Germany, Europe’s largest economy. The increase suggested money poured into the nation’s assets even as developing nations from Brazil to India saw an exit of capital because of concern the Federal Reserve will taper stimulus.

Yi, who is also head of the State Administration of Foreign Exchange, said in the speech that the yuan’s appreciation benefits more people in China than it hurts.

‘Less Interventionist’

His comments are “consistent with the plans to increase the renminbi’s flexibility so they become less interventionist,” Sacha Tihanyi, senior currency strategist at Scotiabank in Hong Kong, said by phone today. The central bank may widen the yuan’s trading band in “the coming few months,” he added.
