Public-private partnerships can cause a breakthrough in deadlocked talks between government and industry. The internet is in most countries predominantly privately owned, and the internet knowledge is 100% privately owned. Therefore, the solutions to these problems can be found in direct cooperation between member-states and the Internet business. Germany, Spain, the United Kingdom, the Netherlands, Belgium all believe in the importance of coordination on this subject and submitted a project proposal to the Prevention of and Fight against Crime Programme of the European Commission. In May 2011 they received a grant to execute the project.

Non-legislative approach

The main objective of this project is to develop a non-legislative ´framework´ that consists of general principles and best practices. The general principles will be developed through a bottom up process where the private sector will be in the lead. Through a series of workshops and conferences, the private and public sector will define their problems and try to draw up principles. These principles can be used as a guideline or gentlemen’s agreement, and can be adopted by many partners. They will describe responsibilities and concrete steps public and private partners can take to counter the illegal use of Internet.

General principles

The principles can fill the gap between Member States (national) regulation and private initiatives / best practices. Because these general principles are co-produced by internet industry and governmental organizations, this project is likely to boost the public-private cooperation and achieve more law-compliance on the internet. Best practices in the public and private sector will be identified and can be implemented voluntarily.(!!!!!!) The result will be an implementation guideline which can be attached to the general principles.

Public-Private-Partnerships

In this project it is the private sector we would like to be in the lead for finding solutions. The projectteam facilitates an open dialogue by organising several workshops and conferences. The public partners, mainly Law Enforcement or Security / Counter Terrorist Organisations, will focus on explaining the phenomenon of terrorism on the Internet. At least after each workshop, a working document is published on this website, based on the input from participants in CleanIT workshops. During the project this document does not necessarily fully reflect the opinions of all persons and organisations involved. It is open for online discussion. (*** AANDACHT !!!! ) A small editorial board is formed from people from the private sector to collect and edit all comments.</sub>

<sub>A leaked document from the CleanIT project shows just how far internal discussions in that initiative have drifted away from its publicly stated aims, as well as the most fundamental legal rules that underpin European democracy and the rule of law.

The European Commission-funded CleanIT project claims that it wants to fight terrorism through voluntary self-regulatory measures that defends the rule of law.

The initial meetings of the initiative, with their directionless and ill-informed discussions about doing “something” to solve unidentified online “terrorist” problems were mainly attended by filtering companies, who saw an interesting business opportunity. Their work has paid off, with numerous proposals for filtering by companies and governments, proposals for liability in case sufficiently intrusive filtering is not used, and calls for increased funding by governments of new filtering technologies.

The leaked document contradicts a letter sent from CleanIT Coordinator But Klaasen to Dutch NGO Bits of Freedom in April of this year, which explained that the project would first identify problems before making policy proposals. The promise to defend the rule of law has been abandoned. There appears never to have been a plan to identify a specific problem to be solved – instead the initiative has become little more than a protection racket (use filtering or be held liable for terrorist offences) for the online security industry.

The proposals urge Internet companies to ban unwelcome activity through their terms of service, but advise that these “should not be very detailed”. This already widespread approach results, for example, in Microsoft (as a wholly typical example of current industry practice) having terms of service that would ban pictures of the always trouserless Donald Duck as potential pornography (“depicts nudity of any sort ... in non-human forms such as cartoons”). The leaked paper also contradicts the assertion in the letter that the project “does not aim to restrict behaviour that is not forbidden by law” - the whole point of prohibiting content in terms of service that is theoretically prohibited by law, is to permit extra-judicial vigilantism by private companies, otherwise the democratically justified law would be enough. Worse, the only way for a company to be sure of banning everything that is banned by law, is to use terms that are more broad, less well defined and less predictable than real law.

Moving still further into the realm of the absurd, the leaked document proposes the use of terms of service to remove content “which is fully legal”... although this is up to the “ethical or business” priorities of the company in question what they remove. In other words, if Donald Duck is displeasing to the police, they would welcome, but don't explicitly demand, ISPs banning his behaviour in their terms of service. Cooperative ISPs would then be rewarded by being prioritised in state-funded calls for tender.

CleanIT (terrorism), financed by DG Home Affairs of the European Commission is duplicating much of the work of the CEO Coalition (child protection), which is financed by DG Communications Networks of the European Commission. Both are, independently and without coordination, developing policies on issues such as reporting buttons and flagging of possibly illegal material. Both CleanIT and the CEO Coalition are duplicating each other's work on creating “voluntary” rules for notification and removal of possibly illegal content and are jointly duplicating the evidence-based policy work being done by DG Internal Market of the European Commission, which recently completed a consultation on this subject. Both have also been discussing upload filtering, to monitor all content being put online by European citizens. (!!!!!!!!!!!!!!!)

CleanIT wants binding engagements from internet companies to carry out surveillance, to block and to filter (albeit only at “end user” - meaning local network - level). It wants a network of trusted online informants and, contrary to everything that they have ever said, they also want new, stricter legislation from Member States.

Unsurprisingly, in EDRi's discussions with both law enforcement agencies and industry about CleanIT, the word that appears with most frequency is “incompetence”.

Key measures being proposed:

Removal of any legislation preventing filtering/surveillance of employees' Internet connections
Law enforcement authorities should be able to have content removed “without following the more labour-intensive and formal procedures for 'notice and action'”

“Knowingly” providing links to “terrorist content” (the draft does not refer to content which has been ruled to be illegal by a court, but undefined “terrorist content” in general) will be an offence “just like” the terrorist

Legal underpinning of “real name” rules to prevent anonymous use of online services


ISPs to be held liable for not making “reasonable” efforts to use technological surveillance to identify (undefined) “terrorist” use of the Internet

Companies providing end-user filtering systems and their customers should be liable for failing to report “illegal” activity identified by the filter

Customers should also be held liable for “knowingly” sending a report of content which is not illegal

Governments should use the helpfulness of ISPs as a criterion for awarding public contracts
The proposal on blocking lists contradict each other, on the one hand providing comprehensive details for each piece of illegal content and judicial references, but then saying that the owner can appeal (although if there was already a judicial ruling, the legal process would already have been at an end) and that filtering such be based on the “output” of the proposed content regulation body, the “European Advisory Foundation”

Blocking or “warning” systems should be implemented by social media platforms – somehow it will be both illegal to provide (undefined) “Internet services” to “terrorist persons” and legal to knowingly provide access to illegal content, while “warning” the end-user that they are accessing illegal content

The anonymity of individuals reporting/VERRADERS (possibly) illegal content must be preserved... yet their IP address must be logged to permit them to be prosecuted if it is suspected that they are reporting legal content deliberately and to permit reliable informants' reports to be processed more quickly

Companies should implement upload filters to monitor uploaded content to make sure that content that is removed – or content that is similar to what is removed – is not re-uploaded

It proposes that content should not be removed in all cases but “blocked” (i.e. make inaccessible by the hosting provider – not “blocked” in the access provider sense) and, in other cases, left available online but with the domain name removed.

Ik kan er op dit moment nog geen namen op plakken, maar het zijn de mensen van de Europese Commissie, afdeling "Home Affairs". Blijkbaar zoiets als (het zieke/criminele) DHS (Homeland Security) in de VS. Veiligheidsdiensten van de EC dus... net zoals DHS dat is in de VS.

2 oktober 2012 Er is weinig verbeelding voor nodig om te bedenken dat onder Project Clean IT straks alle kritiek op de EU en Brussel zal worden weggefilterd.




<sub>De ACTA wet is van tafel, maar de EU probeert op zijn zo kenmerkende slinkse wijze dezelfde maatregelen die totale controle over het internet mogelijk maken alsnog via een achterdeurtje in te voeren door er simpelweg een ander naampje aan te geven: Project Clean IT. Hetzelfde gebeurde destijds met de Europese Grondwet, die door de Nederlandse en Franse bevolking werd afgewezen, maar later middels het Verdrag van Lissabon alsnog werd ingevoerd.

De EU accepteert geen 'NEE' bij de stapsgewijze vorming van een financiële en politieke Unie met één centrale regering in Brussel. Dat weten de Ieren heel goed; zij moesten maar liefst 3 x moesten stemmen over het gewraakte Verdrag van Lissabon, net zolang totdat het gewenste 'JA' was afgedwongen.

'Ongewenste inhoud' wordt weggefilterd en bestraft
Ondanks het feit dat het Europese Parlement afgelopen juli de ACTA wet afwees, nam de Europese Commissie met de 'Notice-and-Action' maatregel alvast een voorschot op het zogenaamde Project Clean IT, feitelijk niets anders dan een andere naam voor ACTA. Onder het mom van terrorismebestrijding wordt straks alle communicatie via het internet gecontroleerd door private bedrijven, die door de Duitse, Nederlandse, Britse, Spaanse en Belgische belastingbetalers gefinancierd zullen worden.

Deze ondernemingen krijgen de verplichting 'ongewenste inhoud' te filteren en de instanties in te lichten als strafrechtelijke vervolging noodzakelijk wordt geacht. Volgens de burgerrechtenbeweging European Digital Rights (EDRi) blijkt uit het officiële voorstel dat ook legale informatie mag worden verwijderd. Het is de bedoeling dat deze totale controle over en censuur van het internet, die verdacht veel op hetzelfde systeem als in China wordt gehanteerd lijkt, al over twee jaar ingevoerd is.

Niet meer anoniem op het net
Ook het onmogelijk maken van het anoniem gebruiken van het internet en het uitbreiden van de controle over sociale netwerken wordt bediscussieerd. 'Het lijkt de gewoonte te worden dat, zodra het op democratische wijze mislukt, overheidsinstellingen deals met private ondernemingen proberen te maken,' gaf Sebastian Nerz, plaatsvervangend voorzitter van de Duitse Piratenpartij als commentaar. De nieuwe 'Notice-and-Action' richtlijn moet het alvast mogelijk maken om providers te verplichten alle 'illegale' informatie en inhoud van websites te verwijderen en de toegang tot deze sites te blokkeren. Het betreft hier niet alleen schendingen van auteursrechten maar naar het zich laat aanzien ook legale informatie als deze door providers als controversieel wordt beschouwd. Feitelijk betekent dit het begin van de invoering van ongelimiteerde censuur. (2)</sub>

Onder het mom van terrorismebestrijding wil de EU/Europese Commissie het project dat het censureren van het internet mogelijk maakt er doordrukken zonder enige inspraak van de burger.

Na Clean IT zal het vrije internet in de EU geschiedenis zijn.

Acta ist gescheitert, aber die EU versucht weiter, auf anderem Wege, die Zensur im Internet durchzusetzen. Offizieller Grund ist die Bekämpfung des Terrorismus. Das dafür ins Leben gerufene EU-Projekt „Clean IT“ stößt bei Datenschützern auf heftigen Widerstand.

De Europese Commissie geeft het niet op, alhoewel ACTA in de prullenmand verdween na het wegstemmen ervan door het Europees parlement zullen ze deze wetgeving toch invoeren. Dit via een voor de EU zeer gekende manier van werken... via een achterdeurtje.

Das Europäische Parlament hat das Acta-Abkommen im Juli zurückgewiesen, aber die EU-Kommission will nun auf anderem Wege die mögliche Zensur im Internet vorantreiben. Alles natürlich nur, um die Urheberrechte zu schützen und „schmutzige“ Inhalte aus dem Netz zu entfernen.



Blijkbaar was CETA niet voldoende...
